Welcome to Tokos (referred to as “Tokos,” “we,” “our,” or “us”). By accessing or using our platform at www.tokos.ca (the “Platform”), you agree to comply with and be bound by these Terms of Service (the “Terms”). Please read them carefully before using the Platform.

If you do not agree with these Terms, you must not access or use Tokos.

  1. Scope and Nature of Services

Tokos operates an online marketplace that connects immigration professionals, service providers, and applicants for global mobility services such as immigration, study, or work abroad.

Tokos acts solely as an intermediary and technology provider. Tokos does not provide immigration advice, legal representation, or professional services to users.

  1. Transactions and Payments • All official transactions must take place exclusively through the Tokos Platform. Any payment or agreement made outside the platform is not covered, protected, or recognized by Tokos. • Tokos will not be responsible for any losses, disputes, or fraudulent activities that occur outside the Platform. • Users who complete transactions or make payments directly to another user, partner, or service provider do so at their own risk. • By conducting transactions through the Platform, you agree that Tokos may hold, process, and release payments according to the Platform’s payment policies.

  1. Relationship Between Users • Tokos is not a party to any agreement between users. • Each immigration professional or service provider is independent, and Tokos does not supervise, endorse, or guarantee the quality, accuracy, or results of their services. • Applicants and service providers are solely responsible for verifying each other’s qualifications, reputation, and compliance with applicable laws.

  1. Refunds and Cancellations • Refunds are not guaranteed and are processed only in accordance with Tokos’ internal policies and the applicable laws. • Refund requests must be submitted in writing through the official support channels of Tokos. • Transactions made outside the Platform are not eligible for any refund, mediation, or support. • Once a service is delivered or initiated, Tokos reserves the right to deny any refund request.

  1. User Responsibilities

By using the Platform, you agree to: • Provide accurate and up-to-date information. • Respect all applicable laws and regulations. • Refrain from engaging in misleading, fraudulent, or abusive behavior. • Use the Platform only for lawful purposes and in accordance with these Terms.

Tokos reserves the right to suspend or terminate any account that violates these Terms or engages in any activity deemed harmful to the Platform or its users.

  1. Limitation of Liability

To the maximum extent permitted by law, Tokos, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, including loss of profit, data, or goodwill, resulting from: • use or inability to use the Platform, • reliance on information provided by users or third parties, • transactions or communications between users, • or any actions taken outside of the Tokos Platform.

All users acknowledge that Tokos provides a facilitating platform only and cannot be held liable for professional misconduct, service quality, visa outcomes, or immigration decisions made by governments or third parties.

  1. No Guarantee of Results

Tokos does not guarantee the success of any immigration application, service outcome, or approval by any government, institution, or employer. All decisions are made solely by the relevant authorities or service providers, independent of Tokos.

  1. Dispute Resolution • Any dispute between users (applicants and service providers) must first be addressed directly between the parties. • If unresolved, Tokos may, at its sole discretion, offer limited mediation as a neutral third party, but Tokos shall not be legally bound to settle or compensate for any claim. • All disputes involving Tokos shall be governed by the laws of Quebec, Canada, and subject to the exclusive jurisdiction of its courts.

  1. Intellectual Property

All content, trademarks, and materials displayed on Tokos, including logos, designs, and texts, are the exclusive property of Tokos or its licensors. Users may not copy, reproduce, or distribute such content without written consent.

Tokos reserves the right to modify, suspend, or update these Terms at any time. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms.
